The agreement between Follow The Market Pty Ltd and the people and businesses who use our price-intelligence platform.
01 — Acceptance
Acceptance
By creating an account, accepting an invitation to a tenant, or otherwise using Follow The Market (“the service”), you agree to these Terms of service and to our Privacy policy. If you don’t agree to either, don’t use the service.
If you’re accepting these Terms on behalf of a company or other organisation, you confirm that you have authority to bind that organisation to this agreement.
02 — The service
The service
Follow The Market is a price-intelligence platform for Australian retailers. We help you monitor competitor prices, generate reposition suggestions, and report on your position in the market over time. The service is provided on a multi-tenant model — each customer’s catalogue, repositions, and history are logically isolated.
We may change, add, or retire features as the product evolves. Material changes that meaningfully reduce functionality you’re paying for will be communicated to the email address on your account.
03 — Account
Your account
You must be at least 18 years old to use the service. You agree to provide accurate information when you sign up and to keep it current. Don’t share your login credentials. You are responsible for everything that happens under your tenant, including the actions of users you’ve invited.
If you become aware of unauthorised access to your account or tenant, notify us promptly at security@followthemarket.com.au.
04 — Acceptable use

You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of the service.
- Use the service to spam, harass, defame, or stalk anyone.
- Attempt to gain unauthorised access to any competitor’s systems, accounts, or non-public data.
- Operate automated agents that bypass our rate limits or abuse pricing endpoints.
- Use the service to support any illegal activity, or to violate any third party’s rights.
We may suspend or terminate access if we reasonably believe you are in serious or repeated breach of this section.
05 — Your content
Your content and data
You own your catalogue, your costs, your competitor configuration, and any notes or repositions you create. By using the service you grant us a non-exclusive, worldwide, royalty-free licence to host, process, transmit, and display your data solely to provide the service to you.
You can export your catalogue and reposition history at any time from inside the app. After your subscription ends we handle your data per the retention rules in our Privacy policy.
06 — IP
Our intellectual property
The Follow The Market brand, the product, the public indexer, our website, our scrape adapters, our matching models, and our documentation are owned by Follow The Market Pty Ltd or our licensors. Using the service grants you no ownership of these assets and no licence to use our brand other than referring to us factually.
Feedback you send us about the product is licensed to us on a perpetual, royalty-free basis so we can act on it without surprise — but we treat your data, not your feedback, as confidential.
07 — Billing
Subscription, billing, and cancellation
Plans are offered in monthly and annual billing periods. Prices are published on followthemarket.com.au and are quoted in Australian dollars. Unless stated otherwise, prices exclude GST, which is added at the prevailing rate where applicable.
You can cancel at any time. Cancellation takes effect at the end of your current paid period — you keep the service until then. We don’t offer refunds for partial periods unless we are required to under the Australian Consumer Law.
If a payment fails, we’ll retry. After repeated failures we may suspend access until billing is resolved.
08 — Indexer
Public data and lawful indexing
Our indexer reads publicly reachable product pages only. It identifies itself by a published User-Agent string, respects robots.txt (including Crawl-delay), throttles requests, and captures evidence for the prices it surfaces to you. Full details are at our Indexer policy.
We do not breach paywalls, bypass authentication, scrape personal data, or harvest content beyond what is needed to surface a price signal.
09 — Disclaimers
Disclaimers
Within the limits of the Australian Consumer Law, the service is provided “as is” and “as available”. We do not guarantee that competitor data is complete, accurate, or current — the upstream sites we read change without notice, and pricing signals are best-effort observations, not commitments.
AI-generated suggestions (reposition recommendations, matching, copy) are starting points for your judgement, not financial, legal, or business advice. You remain responsible for the pricing decisions you make.
10 — Liability
Limitation of liability
To the maximum extent permitted by law, neither party is liable to the other for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost business opportunity, or loss of data, arising out of or relating to these Terms or the service.
Our total aggregate liability for any claim under these Terms is capped at the fees you actually paid us in the twelve months immediately before the event giving rise to the claim.
Nothing in this clause excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded.
11 — Indemnity
Indemnification
You agree to indemnify and hold Follow The Market Pty Ltd harmless against losses, costs, and reasonable legal fees arising from your misuse of the service, your breach of these Terms, or your violation of a third party’s rights through your use of the service.
12 — Jurisdiction
Governing law and jurisdiction
These Terms are governed by the laws of New South Wales, Australia. Each party submits to the exclusive jurisdiction of the courts of New South Wales and the courts entitled to hear appeals from them.
13 — Updates
Changes
We may update these Terms as the product and legal landscape evolve. Material changes will be emailed to the address on your account at least 30 days before they take effect. Continuing to use the service after that date constitutes acceptance of the new Terms. If you don’t agree to the update, you can cancel before it takes effect and we’ll refund any pre-paid, unused subscription period.
